Securing a European patent through the EPO is a major achievement, but the protection only extends as far as you take it. After the grant is published in the European Patent Bulletin, you have just three months to validate the patent in each chosen EPC member state. That’s when European patent translation becomes critical. Skip a requirement or get the wording wrong, and your rights can vanish in that country overnight—leaving your invention exposed.

The validation process itself is straightforward in principle but messy in practice. You file the necessary documents with each national patent office, pay the local fees, and supply any required translations. The EPO itself grants the patent in English, French, or German, yet most of the 39 EPC contracting states still impose their own language rules. Some accept the original text; others demand full translations of the entire specification, including drawings and claims. Coordinating all of this across borders quickly turns into a logistical and financial headache.

Here’s where the London Agreement changed everything. Signed in 2000 and in force since May 2008, this optional pact has been ratified by more than 20 EPC states. It slashes translation obligations in three clear tiers:

  • Nine states (Germany, France, the United Kingdom, Belgium, Ireland, Luxembourg, Monaco, Switzerland/Liechtenstein, and others that share an EPO official language) require no translation at all. Once fees are paid, the patent takes effect automatically.

  • Roughly 13 other states ask only for a translation of the claims—the legally binding core of the patent—plus a modest publication fee.

  • The remaining states still need the full specification translated.

This simplification is not theoretical. Independent economic analysis showed that the London Agreement cut average translation costs by around €3,600 per patent, delivering hundreds of millions in total savings to European businesses.
